Location information relating only to an object or animal is not necessarily personal data by itself. 5. Location History

petZeye provides customers with access to historical GPS tracking information as part of certain services.

Under the current petZeye service configuration, GPS tracking history may be retained and made available for up to six months, depending on the device, subscription and service concerned.

After the applicable retention period, historical tracking information may be automatically deleted, anonymised or otherwise made unavailable, unless it must be retained for a longer period for a legitimate legal, security or dispute-related reason.

Customers should export or save information they legitimately require before the applicable history period expires.

6. Tracking Portal and Application Information

When you use the petZeye tracking portal or mobile application, we may process information including:

Depending on the circumstances, this may require informing the person concerned, obtaining consent or complying with employment, privacy or other applicable laws.

Customers must not use petZeye products or services for unlawful, covert, abusive or unauthorised surveillance.

Examples where particular care may be required include tracking:

·        elderly or vulnerable persons

·        another person’s vehicle or property

Where a parent or legal guardian uses a petZeye product in connection with a child, the parent or guardian is responsible for ensuring that the use is lawful and appropriate.

Nothing in this Privacy Policy removes any independent GDPR or privacy obligations that may apply to a customer using the petZeye service.

12. Sharing Personal Data

We do not sell personal data for monetary consideration.

We may disclose personal data to trusted third parties where necessary to operate our business and provide our services. These may include:

E-commerce providers: We use Shopify to operate parts of our online store and e-commerce services.

Payment and subscription providers: Payment processors and billing providers may process information required to complete payments and administer subscriptions.

Delivery and courier companies: Delivery information may be disclosed to couriers and logistics providers to deliver orders or process returns.

Processors are permitted to process personal data only for authorised purposes and according to applicable contractual instructions, except where otherwise required by law.

Some of the service providers and technical systems used by petZeye may be located outside Cyprus or outside the European Economic Area (“EEA”).

Certain petZeye tracking infrastructure may be hosted in the United Kingdom.

Where personal data is transferred to a country outside the EEA, petZeye will use a transfer mechanism permitted by the GDPR where required. Such mechanisms may include:

We do not retain personal data indefinitely simply because an individual has not requested its deletion.

Retention periods differ according to the type of information.

GPS and location history: Generally retained for up to six months where provided as part of the tracking service, subject to the applicable service configuration and lawful exceptions.

Account information: Retained while the account remains active and for an appropriate period afterwards where necessary for account administration, security, disputes or legal obligations.

Subscription information: Retained for the duration of the subscription and for an appropriate period afterwards for payment, accounting, dispute and legal purposes.

Order and invoice information: Retained for the period required by applicable accounting, taxation and commercial legislation.

Customer-support information: Retained for as long as necessary to investigate and resolve the support matter and for an appropriate period afterwards where reasonably required for service, security or legal purposes.

Security and technical logs: Retained for a limited period appropriate to the security, diagnostic or operational purpose concerned.

Marketing information: Retained until consent is withdrawn, the individual objects, or the information is no longer required for the relevant marketing purpose.

We may retain limited suppression information after an unsubscribe request to ensure that we continue to respect the individual’s marketing preference.

Where information is required in connection with litigation, regulatory proceedings, fraud prevention or another legal obligation, it may be retained for longer.

We use cookies and similar technologies on petzeye.com. Our cookie preference system allows visitors to choose which non-essential categories they wish to permit.

Where a personal data breach is required to be notified to the competent supervisory authority or affected individuals under applicable data protection legislation, petZeye will make the required notification within the applicable legal requirements.

petZeye does not currently use customer personal data to make decisions based solely on automated processing that produce legal effects or similarly significant effects on individuals.

Some third-party service providers, including e-commerce or payment providers, may use automated tools to identify suspected fraud, abusive transactions or security risks.

Such processing may include temporary risk indicators relating to payment methods, IP addresses or transactions.

Where applicable, these providers operate under their own legal and privacy obligations.

We aim to respond without undue delay and normally within one month. Where a request is particularly complex or numerous requests are received, the GDPR permits this period to be extended by up to two additional months, provided the individual is informed within the original one-month period.

A customer may request deletion of personal data or an account by contacting petZeye.

Data contained in routine backups may remain for a limited period until the backup is overwritten or expires in accordance with our retention procedures.

26. Tracking Data Relating to Another Individual

In some cases, the petZeye account holder and the person whose movements can be inferred from the GPS device are not the same person. Examples may include:

·        an employer and employee

·        a fleet operator and driver

·        a parent or guardian and child

·        a car owner and authorised driver

·        a person assisting an elderly or vulnerable relative

In these circumstances, the account holder must ensure that the use of the GPS device complies with applicable privacy, employment, surveillance and other laws.

Where required, the account holder is responsible for providing appropriate privacy information to the relevant person and obtaining any legally required consent or other lawful basis.

petZeye does not authorise the use of its products for unlawful surveillance.

27. Children

The petZeye website and customer accounts are not intended to be independently used to purchase services by children under 16 years of age.

We do not knowingly invite children under 16 to create independent customer accounts or purchase subscriptions directly.

A parent, guardian or other authorised adult may use a petZeye service in relation to a minor where doing so is lawful and appropriate.

If you believe a child has provided personal data directly to petZeye without appropriate authorisation, please contact dpomanager@petzeye.com.

Our website or applications may contain links to websites or services operated by third parties.

petZeye does not control the privacy practices of independent third parties.
